Membership Terms

All-inclusive gym memberships at Phoenix Wellness Center, LLC require a minimum commitment of twelve (12) months. Upon completion of the initial membership term, the membership will automatically continue on a month-to-month basis unless canceled in accordance with this agreement.

To cancel a membership after the initial twelve (12) month term, members must submit a written cancellation request at least fifteen (15) days prior to their next billing date.

Membership Freeze Policy

Members may request to freeze their membership for up to three (3) months during the membership term. Any approved freeze period will be added to the end of the membership agreement and will extend the contract term accordingly.

Assumption of Risk and Health Acknowledgment

I acknowledge that I am voluntarily participating in activities, programs, services, classes, training sessions, and use of facilities provided by Phoenix Wellness Center, LLC.

I understand that participation in physical exercise, fitness training, wellness programs, and related activities involves inherent risks, including but not limited to serious bodily injury, illness, permanent disability, and death.

I affirm that I am physically capable of participating in these activities and understand that it is my responsibility to consult with a physician or other qualified healthcare provider before beginning any exercise or wellness program. I represent and warrant that I have no medical condition, impairment, or injury that would prevent my safe participation.

Release of Liability

I voluntarily assume full responsibility for all risks, known and unknown, associated with participation in programs and use of facilities at Phoenix Wellness Center, LLC.

Such risks may include, but are not limited to:

  • Heart attack or other cardiovascular events

  • Muscle strains, pulls, tears, or soreness

  • Broken bones or fractures

  • Sprains and joint injuries

  • Back, knee, foot, or other orthopedic injuries

  • Heat exhaustion, heat stroke, or dehydration

  • Illness, infection, or other medical complications

  • Permanent disability or death

In consideration of being permitted to participate, I knowingly and voluntarily release, waive, discharge, and hold harmless Phoenix Wellness Center, LLC, its owners, employees, contractors, trainers, instructors, agents, representatives, and affiliates from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising from or related to my participation, including those resulting from ordinary negligence to the fullest extent permitted by law.

I further agree that neither I nor my heirs, beneficiaries, personal representatives, or assigns will bring any claim or lawsuit against Phoenix Wellness Center, LLC for injuries, damages, losses, or death arising out of participation in its programs or use of its facilities.

Release of Liability

I understand and agree that all membership fees, training fees, and program fees are non-refundable.

Unused memberships, sessions, classes, services, or packages will not be refunded.

I understand that all recurring payments and charges will be automatically processed using the payment method provided and maintained on file.

Cancellation Policy

If I wish to cancel my membership after fulfilling my contractual obligations, I agree to submit my cancellation request in writing.

Phoenix Wellness Center, LLC does not accept cancellations submitted by text message, voicemail, email, social media message, or verbal communication. Written cancellation notices may be delivered directly to the facility or submitted through approved written methods designated by management.

Photo and Media Release

I grant Phoenix Wellness Center, LLC permission to photograph, video record, or otherwise capture my likeness while participating in activities at the facility.

I authorize Phoenix Wellness Center, LLC to use such photographs, videos, recordings, and other media for promotional, educational, advertising, marketing, and business purposes without compensation, inspection rights, or further approval.

Security Camera Acknowledgment

I acknowledge and understand that Phoenix Wellness Center, LLC utilizes video surveillance and security camera systems throughout portions of its facility for safety, security, operational, and liability purposes.

By entering and using the facility, I consent to being recorded by such surveillance systems and understand that recordings may be reviewed, retained, and used by Phoenix Wellness Center, LLC as necessary for legitimate business, security, legal, or safety purposes.
